EEO-1 Filing Period Is Now Open

The U.S. Equal Employment Opportunity Commission (EEOC) launched its annual EEO-1 data collection process earlier this month. The mandatory data collection process requires all private-sector employers with 100 or more employees and federal contractors with 50 or more employees meeting certain criteria to submit demographic workforce data, including data by race/ethnicity, sex, and job categories.

After delaying the opening of the 2019 EEO-1 Component 1 data collection process because of the COVID-19 public health emergency, the EEOC announced that the 2019 and 2020 EEO-1 Component 1 data collection is NOW OPEN. Eligible employers have until Monday, July 19, 2021, to submit two years of data.

Filing Component 1 Data

If a company has filed in the past, they will receive a letter from the EEOC with instructions. 

Employers must file the EEO-1 Component 1 Report for each year they were in business and met the filing requirements. Eligible companies will be required to first file for 2019, then file for 2020 after the 2019 report is submitted and certified. 

If the company was not eligible in 2019, it would need to certify it was ineligible before filing for 2020. If the company was ineligible in 2020 but was eligible in 2019, it will need to file the 2019 EEO-1 data first, then certify it was ineligible in 2020.

Who Must File

Employers with 100 or more employees, federal contractors with 50 or more employees, and a limited number of additional employers detailed on the EEOC website are required to file an EEO-1. Employers count employees during a “workforce snapshot period” between October 1 and December 31. The EEOC delayed collection of the 2019 data due to the COVID-19 pandemic and has extended the data collection period from 10 to 12 weeks to provide employers more time to file.

What Information Is Needed To File

Employers will need the following information:

  • Company ID and passcode (provided via U.S. mail for previous filers or at registration for new filers)
  • Company EIN, NAICS Codes, and DUNS Number
  • Address and EINs of all establishment locations
  • Count of all full and part-time employees during the workforce snapshot pay period selected by the employer
  • Sex and race/ethnicity of all employees
  • Job categories of all employees

Register with the EEOC at www.eeocdata.org and then file the Component 1 Form with Aatrix through your payroll solution.
